Cost

Mediation

Mediation is a voluntary process where parties attempt to reach an agreement outside the courtroom. The majority of custody cases actually settle with an agreement between the parties; trial is the exception. The court requires every case to at least make an attempt at mediation before the court will schedule your case for trial. Mediated settlement agreements can usually create win-win solutions that are tailored to the special circumstances of your family.

Evidence

If you are unable to reach an agreement, it may be necessary to take your case to trial. At trial, a Utah District Court Judge will determine the legal and physical custody of your minor children. There are no juries for family law cases. In preparing for trial, it will be necessary for you to gather information for the court to consider. Examples of some typical evidence in custody cases are: text exchanges between parents, email exchanges between parents, children’s grades and attendance, children’s medical records, and more.
