Do I Have a Workers’ Comp Case?

Nearly every private and governmental employer in Utah is required to maintain workers’ compensation insurance for their employees, which means you should be entitled to compensation for any on-the-job injuries you sustain. Now, how exactly do you categorize an injury as “work-related?” Essentially, it depends on whether or not you were “on the clock” or on the premises at the time you were injured. Even if you weren’t at work when the incident took place, you could still receive benefits if you were doing something to benefit the employer when you were injured.

If, for example, you’re injured while walking through your office building during business hours, you could be eligible to receive workers’ comp. Likewise, a construction worker driving from one work site to another could also receive compensation if he or she was in an accident. Although a person wasn’t at work at the time of the accident, he or she was still “working,” and should still be covered for workers’ compensation benefits. This includes medical expenses, 2/3 of wages for time off from work for recovery, and additional money for permanent restriction. Injured workers who can never return to work may be able to obtain a disability pension in addition to possible Social Security Disability benefits.

By law, your workers’ compensation coverage should kick in as soon as you begin working or training, so you should never have to worry about whether or not you’re entitled to essential benefits if injured at or by your work. Also, the reason for the incident will usually not play a major role in whether or not you receive compensation. Even if your employer claims that the incident was your fault, you should still receive benefits. Because workers’ comp benefits operate on a no-fault system, you won’t be held liable unless you intentionally harmed yourself at work. Be it your fault, the employer’s fault or no one’s fault, you are still covered.

Filing a Workers’ Compensation Claim in Utah

If you were injured at work and you think you have a workers’ compensation case, make sure you take action promptly. After an accident, you have only 180 days to report the injury to your employer, otherwise, you could lose your right to claim benefits, and it is important to seek medical attention as soon as possible, letting the doctor know that you were injured on the job.

Our team specializes in cases involving Utah compensation laws, and we are well versed in Labor Commission issues.
