Utah Criminal Defense Attorney Matthew Kober Removes Name from Registry
Utah criminal defense attorney Matthew Kober is the first criminal defense attorney in Utah to successfully remove a person from the Utah Sex Offender Registry. A Third District Court judge signed the order on January 25, 2013, and the client was removed from the registry on February 1, 2013. In 2012, the Utah Legislature approved a bill to allow a narrow set of individuals to be removed from the sex offender registry under certain conditions.

“This bill allows individuals to move on from a mistake in their past who are no longer threats to society,” explains Utah criminal defense attorney Matthew Kober.
Kober’s client’s (referred to as “Client” to provide anonymity) was the first person to petition the courts for removal under this new law. Approximately 18 years ago, the “Client” met a girl who lied to him about her age. He was subsequently charged with Attempted Unlawful Sexual Activity with a Minor, a Class A Misdemeanor. “Client,” said, “I was not prepared for the long road ahead of me and the obstacles that I was going to have to overcome.”
Registering as a sex offender caused multiple problems in “Client’s” life. He had to live in his parent's condo because apartments would not rent to him. He recalls “I lost my independence and freedom. A parole officer came to my house every month to validate where I lived and what I drove” There was also a financial burden. “I had to pay a yearly fee to the department of corrections, a fee to the police department to come to check up on me, weekly therapy sessions, among other fees”.
Rep. Jack Draxler, R-North Logan, the legislator who originally proposed the bill, HB13, was excited to hear that someone like “Client” was able to utilize the new law. Mr. Draxler stated, “More people need to know that this option is available to people who have reformed their lives and are ready to move forward with their life without the cloud of suspicion above their head.”
